PLEASE READ THESE TERMS AND CONDITIONS OF SALE AGREEMENT VERY CAREFULLY. THE CUSTOMER AGREES TO BE BOUND BY THIS SALE AGREEMENT AND ACCEPTS ITS TERMS AND CONDITIONS (UNLESS THE CUSTOMER HAS SIGNED A SEPARATE FORMAL PURCHASE AGREEMENT WITH LIFELIKE TURF, IN WHICH CASE THE SEPARATE AGREEMENT SHALL GOVERN).
Important Information about this Legal Contract
This Sale Agreement is a legal contract between the Customer and Turf Avenue - Managed By Lifelike Turf. The Customer accepts this Sale Agreement by making a purchase, placing an order, or otherwise shopping on the site. (References to "you" or "your" shall relate to the Customer; references to “Lifelike Turf" shall relate to Lifelike Turf and its affiliates/managed websites.) The terms and conditions of this Sale Agreement are subject to change without prior notice, except that the terms and conditions posted on the site at the time the Customer initially places or modifies an order will govern the order in question. This Sale Agreement constitutes the entire agreement between the Customer and Lifelike Turf relating to the purchase or sale of goods or services on the site. The Sale Agreement may only be modified or terminated with regard to goods or services that have been purchased or sold on the site in writing signed by Lifelike Turf. Electronic records (including signatures), that are otherwise valid, shall be accepted under the Sale Agreement. The Customer consents to receive electronic records, which may be provided via a web browser or e-mail application connected to the Internet; consumers may withdraw consent to receiving electronic records or have the record provided in non-electronic form by contacting Lifelike Turf. In the event of any conflict between the terms and conditions stated on your purchase order and this Sale Agreement or any terms and conditions on our invoice, you agree that the provisions of this Sale Agreement and our invoice shall overrule yours.
Pricing and Information Disclaimer
ALL PRICING ARE SUBJECT TO CHANGE. FOR ALL PRICES, PRODUCTS AND OFFERS, LIFELIKE TURF RESERVES THE RIGHT TO MAKE ADJUSTMENTS DUE TO CHANGING MARKET CONDITIONS, PRODUCT DISCONTINUATION, MANUFACTURER PRICE CHANGES, ERRORS IN ADVERTISEMENTS AND OTHER EXTENUATING CIRCUMSTANCES. WHILE LIFELIKE TURF USES REASONABLE EFFORTS TO INCLUDE ACCURATE UP-TO-DATE INFORMATION ON THE SITE, LIFELIKE TURF MAKES NO WARRANTIES OR REPRESENTATIONS AS TO THE SITE'S ACCURACY. LIFELIKE TURF ASSUMES NO LIABILITY FOR ANY ERRORS OR OMISSIONS IN THE CONTENT OF THE SITER
Limitation of Liability
LIFELIKE TURF WILL NOT BE LIABLE FOR LOST PROFITS, LOSS OF BUSINESS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY EXCEPT AS EXPRESSLY PROVIDED HEREIN. LIFELIKE TURF WILL NOT BE LIABLE FOR PRODUCTS OR SERVICES NOT BEING AVAILABLE FOR USE OR FOR LOST OR CORRUPTED DATA OR SOFTWARE. CUSTOMER AGREES THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCTS OR SERVICES, LIFELIKE TURF IS NOT LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AGGREGATE DOLLAR AMOUNT PAID BY CUSTOMER FOR THE PURCHASE(S) UNDER THIS AGREEMENT.
Orders and Payment
ORDERS ARE NOT BINDING UNTIL ACCEPTED BY LIFELIKE TURF. ALL PAYMENTS ARE MADE ONLINE VIA CREDIT CARD SERVICES AT THE TIME OF CHECK OUT. CUSTOMER AGRESS TO PAY ALL SHIPPING AND HANDLING FEES ASSOCIATED WITH THE ORDER.
1) CLEARANCE/ FINAL SALES: All clearance items are
final sales. CLEARANCE items cannot be returned for exchange, credit, or
refunds; unless received damaged, defective, or the wrong item(s).
2) For all other items, to be eligible for an exchange, credit, or refund as described below, you must have preapproval by our office in writing within five days of receiving the product.
How to Return:
The merchandise will only be eligible for return on approved carriers. Rolls of turf must be in the original unopened packaging and/or in approved wrapping method.
Approved wrapping method: If you unwrapped the turf and rolled it out. It will need to be rolled up as tight and as clean as it was shipped originally. If you need to rewrap the roll it will need to be in new 6 to 8mil plastic wrap and then taped extensively so it is secured for shipping.
ALL RETURNS MUST BE NEW & UNUSED WITH ORIGINAL BOX AND/OR
APPROVED PACKAGING - WE DO NOT ACCEPT COD RETURN.
AFTER RETURNS ARE PROCESSED WE SHALL ISSUE CREDIT TO CUSTOMERS ORIGINAL CREDIT CARD - NO CASH REFUND.
A 25% RESTOCKING FEE WILL APPLY TO ANY RETURN THAT DOES NOT MEET THE BELOW 2 CONDITIONS. CUSTOMERS ARE RESPONSIBLE FOR THE RETURNING DELIVERY FEE.
1. Wrong product - If customer received a wrong product due to our shipping mistake, please notify us within 5 business days and we shall arrange for you to return the incorrect product (at our expense) and we shall ship you the correct product or issue you a full credit (including shipping fees).
2. Defective product - If customer received a defective product, please notify us with 5 business days and we shall arrange for you to return the product (at our expense) back to us. After we have examined and confirmed the defective product, we shall issue a credit to the customer.
Cancellations can only be approved prior to shipping and customers refund
will be applied to the original credit cards within three business days.

Shipping & Delivery Policy
All orders placed before 1:30pm will be processed that day and dispatched in one to two days. We see most orders arriving in about 7 to10 days. All deliveries will be made during the week (Monday through Fridays, excluding holidays). A day or two prior to delivery to a residence you should receive a phone call from the freight company. They will call to schedule based off of their route trucks schedule and your schedule. The delivery is curbside only and the customer is responsible for getting it off the truck and moving the turf into a safe location. Please be aware that it can be very heavy. In the unlikely event that you have any problems with your delivery please contact us and we will do all we can to ensure that your problem can be resolved.
